1. Introduction
These are the Terms of Use from which access is granted by Koodoo Financial Limited (‘Koodoo’), to Users of https://koodoo.io ('the Website'), or to users of Koodoo’s mortgage comparison and eligibility checking services (‘the Services’). These Terms of Use must be carefully read before accessing and using the Website or the Services. Use of the Website or the Services constitutes express acceptance of these Terms of Use.
2. How we collect data about you and your use of this website or our services
You are in control of what information we collect about you. However, if you choose not to share your information some areas of the Website or our Services may not be accessible or usable. We may ask you for information about yourself when you complete forms on the Website or Services. Please read our Privacy Policy for more information. We and our business partners collect information about your use of the Website or Services from cookies. For information about our use of cookies and how to decline them please read our Cookies Policy. We use your data to improve the service we offer you and to ensure that you get the best from our Website or Services.
3. Services outside authorisation
Our brokerage service only services UK customers and properties in the UK. We will be able to provide advice on residential, buy-to let mortgages, consumer buy-to let mortgages, buy-to let limited companies and company SPVs. We do not allow execution-only and second charges mortgages, later life lending, or expat mortgages.
Koodoo reserves the right to suspend its services in the event that any actions are deemed unlawful, fraudulent, or abusive.
Please note that search results may differ on comparison websites and mortgage advice research documentation. Koodoo advisors will have access to a whole market set of products and will recommend the most suitable product available.
4. Company information
The Website and Services are operated by Koodoo.
Koodoo Financial Limited (referred to as “Koodoo”) has a company number of 11822219 and a registered address of Scale Space, 58 Wood Lane, London W12 7RZ. Koodoo Financial Limited is registered as a Data Controller and Data Processor with the ICO, with registration number ZA560572. Koodoo Financial Limited has a subsidiary company, Mortgage Power Ltd (registered company number 10978680).
This policy is also relevant for other trading names under Mortgage Power Limited, including Get Mortgage Rates, a website which uses Koodoo’s technology to provide mortgage comparison services. Within this policy all references to “Koodoo” refer to all subsidiaries and trading names within the group.
5. Company business
The business of Koodoo is the provision of financial, data and technical services in relation to mortgage comparison and provision.
5.1 Fees
Koodoo’s mortgage comparison service is free of charge to use for all customers. If you decide to proceed with Koodoo for mortgage advice and submit an application, a fee upon completion may apply; you must check and confirm with your broker that you are happy to proceed on this basis.
Mortgage Power Limited charges a £495 fee on the following applications:
Applicants who have any missed payments, defaults, CCJs, bankruptcy orders or Individual Voluntary Arrangements in the last 6 years
Applicants who require debt consolidation or residential lending into retirement
Applications with applicants exceeding 2
Applications with foreign currency income present
All other applications will not be charged a fee at completion.
This means that you will only pay when things go according to plan. As a mortgage intermediary we will receive commission from the lender. Lenders may charge a product fee, we’ll let you know about this when we recommend a product. If you decide to proceed with another broker, you must check carefully on any fees that apply.
6. Return, refund and cancellation policy
Koodoo does not have a refund, return and cancellation policy, but some of its activities may be regulated by the Consumer Credit Act 1974 (as amended) and customers have statutory rights of cancellation of agreements. We only charge a fee on completion of the mortgage; this ensures you only pay when your mortgage application is successful.
7. Access to the website
Koodoo does not guarantee access to the Website or Services on any permanent or interrupted basis. Koodoo reserves the right to withdraw or amend access to the Website or Services without notice, and will not be liable for any loss or damage suffered by any person, firm or corporation arising from the permanent or temporary unavailability of the Website or Services, or of any amendment to the Website or Services. Koodoo reserves the right to restrict access to all or any part of the Website or Services either to users generally or to specific users or specific categories of user. Each legal entity whose employees have access to the Website must ensure that all employees, officers and any workers in any other capacity are aware of these Terms of Use and comply with them at all times.
8. Intellectual property
Koodoo is the owner of all intellectual property rights in the Website and Services, as well as the material displayed on the Website or as part of our Services, withstanding intellectual property owned by our partners but reproduced by Koodoo as part of our Services with their permission. The printing of copies of any material, or the downloading of any aspects, from, the Website or Services is strictly prohibited except for the purposes of personal reference or research. A modification of any copies or downloads of any materials displayed on the Website or Services, or the use of any illustrations, photographs, video or audio sequences or any graphics displayed on the Website or Services separately from any accompanying text is strictly prohibited. Without limiting the generality of the above permissions, the use of any materials displayed on the Website or Services for commercial purposes without the express prior written consent of Koodoo (which Koodoo may or may not grant at its discretion and may grant subject to such conditions as Koodoo might in its absolute discretion determine) is strictly prohibited.
9. Obsolete material
Koodoo does not guarantee that any of the material displayed on the Website or Services from time to time is current or up to date, and will not be liable to any person, firm or corporation using the Website or Services for any loss or damage suffered or incurred as the result of the use of or reliance upon any material displayed on the Website or Services which is in whole or in part obsolete or not fully up to date. Koodoo is under no obligation to update any material currently displayed on the Website or Services.
10. Limitations of liability
Koodoo gives no guarantee, representation or warranty of any kind as to the accuracy or completeness of any other material displayed on the Website or Services from time to time. Koodoo furthermore excludes, to the fullest extent permissible by law, (i) all conditions, warranties or other terms which might otherwise be implied by statute, common law or equity; (ii) any liability for loss of profit, loss of revenue, loss of business or contract, loss of anticipated savings, loss of goodwill or any indirect or consequential loss of any kind suffered or incurred by any person as a result of the use of the Website or Services or any other material displayed on it from time to time, regardless of the cause of action and of whether such loss or damage was foreseeable or Koodoo had been advised of the possibility of such loss or damage arising. Nothing in these Terms of Use shall however exclude or limit the liability of Koodoo for death or personal injury caused by its own negligence, or for fraud or fraudulent misrepresentation.
11. User information
Koodoo will process information regarding users of the Website or Services at all times in accordance with its Privacy Policy. Use of the Website or Services constitutes express consent to such processing, together with a warranty that all data provided is accurate.
12. Viruses, hacking and other offences
The misuse of the Website or Services by the knowing or reckless introduction of viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful is strictly prohibited. Attempting to gain any unauthorised access to the Website or Services, the server on which the Website or Services are stored or any further computer or data entry to the Website or Services is strictly prohibited. Any breach of the above provisions constitutes a criminal offence under the Computer Misuse Act 1990. If Koodoo becomes aware of any such breach, it will report the same to the relevant law enforcement authorities and will co-operate with those authorities by disclosing the identity of the person, firm or corporation responsible for the breach. Koodoo will not be liable for any loss or damage caused by any virus or other technologically harmful material that might affect the computer equipment of any user, any computer programmes data or other proprietary material arising from the use of the Website or Services or any material displayed upon them.
13. Links
Links to the Website or Services are permissible, but not so as to create any impression of any association, approval or endorsement by Koodoo, or any association or connection between Koodoo and the user. The creation of a link to any part of the Website other than the homepage is strictly prohibited, similarly the link to any part of the Services other than the landing page is strictly prohibited. Koodoo reserves the right at anytime to withdraw permission to link to the Website or Services, whether generally or to specified users or categories of user. Any links contained on the Website or Services to other websites promoting goods or services provided by third parties are provided for information only. Koodoo excludes all liability for any loss or damage that any person, firm or corporation might incur as a result of the use of any such link or of any dealings with any third party entered into by the user by means of such link, or arising out of the acquisition or use by the user of any such goods or services.
14. Variation
Koodoo may vary the Terms of Use at any time by amending the Terms of Use as displayed on the Website or Services, but without any obligation to give prior notice to any user of the Website or Services.
15. Law and jurisdiction
These Terms of Use will be construed, interpreted and applied in accordance with English Law, and the Courts of England will have non-exclusive jurisdiction in relation to any claim arising from the accessing or use of the Website by any person, firm or corporation. If you are not satisfied with any Koodoo Financial Ltd product or service we have a complaint handling procedure that you can use to resolve such matters. Information on this procedure will be sent to you in the event of a complaint or upon request. If you are still not satisfied after following our complaint procedure, you can ask the Financial Ombudsman Service to review the complaint within six months of our final response. You can write to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London E14 9SR (telephone: 08000 234 567). The Financial Ombudsman Service is an organisation set up by law to give consumers a free and independent service for resolving disputes with financial firms.
